We will randomly draw one lucky winner within 5 working days after the competition closing and we will send the prize to him/her within 10 working days since the draw.
The organizer of the competition is 1. Zichovecká s.r.o., with registered office at Zichovec 46, postcode 273 74, ID No.: 28434684, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C., Insert 141243 (hereinafter referred to as the “Organizer”).
The Competition runs from 6 August 2021 to 15 September 2021 inclusive (hereinafter referred to as the “Competition Period”).
The Competition is limited to the Czech Republic, the Slovak Republic, Germany, Poland, Austria, Hungary, Belgium, the Netherlands, France, Italy, Bulgaria, Romania, Denmark, Estonia, Lithuania, Latvia, Ireland, Spain, Sweden, Finland, Croatia, Slovenia, Greece, Portugal. The competition is running on social site Instagram.
The Contest is open to natural persons – consumers (hereinafter referred to as “Consumer” or “Contestant”), over 18 years of age, who are fully capable of exercising their legal capacity, with a delivery address in the Czech Republic, Slovak Republic, Germany, Poland, Austria, Hungary, Belgium, the Netherlands, France, Italy, Bulgaria, Romania, Denmark, Estonia, Lithuania, Latvia, Ireland, Spain, Sweden, Finland, Croatia, Slovenia, Greece, Portugal. A participant can be a natural person using his/her active Instagram account for the duration of the competition. Persons in an employment or similar relationship with the Promoter or persons related to the Promoter personally and financially, including their relatives and persons close to them, are excluded from participation in the competition.
The Consumer enters the Competition as follows. The Contestant clicks the “Follow” button on the Instagram profile @pivovarzichovec and becomes a follower of the site, if he/she is not already a follower of the profile. Then, between 6 August 2021 and 15 September 2021 at 23:59, the participant uploads a photo to his/her Instagram profile with one of the Zichovec brewery products at his/her favourite travel spot. At the same time, they will tag the Instagram profile @pivovarzichovec and include the hashtag #summerwithzichovec under the photo. Contestants can participate in the Competition repeatedly, but each time they must meet all the above mentioned conditions of the Competition and each time they must compete with a different photo.
The Competition Organiser has provided a total of 3 beer degustation packs for the Competition, each containing 24 cans with volume 500 ml.
1 winner will be selected in the Competition. The Promoter will select the winner within 5 working days after the end of the competition by random draw. The winner must meet all the conditions for participation in the competition. The winner will then receive 3 ‘Take Zichovec on a trip’ beer tasting packages, each containing 24pcs of 500 ml cans. The winner will be contacted by the organizer via Instagram direct message and the organizer will publish the nickname of the winner in Instastories. If the competition organiser fails to contact the winner within ten working days after the announcement of the competition results, the entitlement to the prize will be forfeited. Any Contestant who fails to properly comply with any of the terms and conditions of participation in the Contest in accordance with the applicable provisions of these rules shall forfeit their entitlement to the prize. If a Winner who has already been selected loses his/her claim to the prize, the Promoter shall be entitled to select a replacement of Winner within 7 days of the date of the Winner’s exclusion in accordance with the procedure set out in this Article of these Rules and notify the Winner of this fact in accordance with these Rules. The losing winner will also be notified of his/her claim to the prize.
The prize will be delivered to the Winner at the Promoter’s expense to the delivery address provided by the Winner in the Instagram direct message, via a shipping company, within 10 days of the Winner being contacted. The Winner acknowledges that the Promoter is entitled to disclose his/her personal data to a third party for the purpose of delivering the prize. At the same time, the third party is entitled to use this data only for the purpose of delivery of the prize and to process it for a maximum period of 3 months. The risk of damage to the prize passes to the winner as soon as the prize is handed over to the winner. The Contestant cannot claim any prize other than the one issued to him/her and is not entitled to claim the prize from the Promoter. The prize cannot be paid out in cash or any other form of consideration as an alternative. Prizes in this competition cannot be exchanged for cash, nor can any prize be claimed other than as specified by the Promoter in these rules. The Promoter accepts no responsibility for any risks or liabilities associated with the use of any prize.
By participating in the Competition, the Contestant agrees to the inclusion of all personal data provided by him/her in the Competition (“Data”) in the database of the Promoter solely for the purpose of evaluating the Competition and awarding prizes. The data of the contestants will not be processed in accordance with Act No. 101/2000 Coll., on the protection of personal data. The contest participants expressly agree that the organizer of the contest is entitled to use, in accordance with Section 12 of Act No. 40/1964 Coll., as amended, the Civil Code, the name, surname, nickname, or Instagram comment in the organizer’s media in connection with the contest and the services provided by the organizer, free of charge.
This Contest is in no way sponsored, endorsed, administered by, or otherwise associated with Instagram Inc. Contestant understands that he/she is providing information to the Contest organizer, not to the Instagram electronic social network or the companies that own and operate such networks.
By entering the Contest, the Contestant acknowledges that he/she has read these Contest Terms and Conditions, agrees to the Contest Rules and agrees to comply fully with them. The Promoter reserves the right to amend the rules or conditions of the competition at any time, including the duration of the competition, or to cancel the competition in its entirety without giving any reason and without providing compensation. The Promoter must notify all competitors of any changes to the terms and conditions of the competition without delay. In the event of a reasonable suspicion of fraudulent, dishonest or unfair conduct by a competitor or any other person who has assisted or may have assisted the competitor in winning, or if such conduct occurs, the competitor may be disqualified from the competition. The Promoter shall not be liable for any damages in connection with participation in the Competition. In the event that the winner cancels the Competition order under which he/she received the prize, he/she must also return the prize to the Promoter. Participation in the Competition does not automatically entitle the entrant to the prize and prizes cannot be legally claimed.
These rules, the competition and the relationship between the Contestant and the Promoter shall be governed by the laws of the Czech Republic, even if the Contestant is not domiciled in the Czech Republic (excluding conflict of laws rules of private international law). This is without prejudice to the rights of consumers under generally binding legislation. Any disputes shall be settled by the competent courts of the Czech Republic, in the Czech language. In addition to these Terms and Conditions, the relationship between the Promoter and the Competitor is subject to certain provisions of the Terms and Conditions published on the www.pivovarzichovec.cz online shop.
These rules are valid and effective from 6 August 2021. These rules may be unilaterally modified by the Promoter at any time. The amendment shall take effect on the date of publication (similar to these Rules).
