The contest organizer is 1. Zichovecká s.r.o., with its registered office at Zichovec 46, Postcode 273 74, Business ID No.: 28434684, registered in the Commercial Register maintained by the Municipal Court in Prague, File C, Insert 141243 (hereinafter referred to as the “Organiser”).
The Contest will take place from 5th of May 2021 until 19th of May 2021 (dates inclusive) (hereinafter referred to as the ‘‘Contest Period’’).
The contest is limited to the territory of the Czech Republic, Slovak Republic, Germany, Poland, Austria, Hungary, Belgium, The Netherlands, France, Italy, Bulgaria, Romania, Denmark, Estonia, Latvia, Lithuania, Ireland, Spain, Sweden, Finland, Croatia, Slovenia, Greece, Portugal.
The contest takes place in the internet store pivovarzichovec.cz (hereinafter referred to as the ‘‘Internet Store’’).
A natural person – consumer (hereinafter referred to as the ‘‘Consumer’’ or ‘‘Contestant’’), over 18 years of age, who is fully legally competent, with a delivery address in the Czech Republic, Slovak Republic, Germany, Poland, Austria, Hungary, Belgium, The Netherlands, France, Italy, Bulgaria, Romania, Denmark, Estonia, Lithuania, Latvia, Ireland, Spain, Sweden, Finland, Croatia, Slovenia, Greece, Portugal may participate in the contest. Employees or persons in a relation similar to employment with the Organiser as well as individuals personally affiliated to the Organiser or affiliated in terms of property, including next of kin and their relatives, are prohibited from participating in the contest.
The Consumer enters the contest in the Internet Store www.pivovarzichovec.cz by registration or logging in (if already registered in the past) and making a contest purchase. Making a contest purchase shall mean that the Contestant makes an order – fills up a full box, enters the code ‘‘TREEHOUSE’’ in the field ‘‘coupon code’’ in the basket, completes this order, and pays the price of the goods that filled up the box in full. To “fill up a ‘full box’’: the box has 12 fields and may be filled by the Consumer as follows – 1 bottle = 1 field, 1 tin = 0.5 field, T-shirt = 0.5 field, glass = 0.5 field. It must concern goods from the Internet Store catalogue with the exception of SILVER AND GOLD BEER SUBSCRIPTION and GIFT VOUCHER in the amount of CZK 500 and 1,000 (the box cannot be filled up with these products).
During the Contest Period the Contestant must also give their consent to the contest rules on the website www.pivovarzichovec.cz, by ticking the box (if they do not tick the box, the Contestant cannot participate in the contest) and consent to the processing of personal data for the purposes of the contest (if they do not tick the box, the Contestant cannot participate in the contest.)
The Consumer is entered in the contest upon receipt of the confirmation message from the website.
The Contestant may participate in the Contest repeatedly, but always only with the contest purchase made and with proper fulfilment of the conditions of participation (e.g. if the Consumer fills up 2 full boxes during 1 purchase, enters the relevant code in the basket, completes the order and pays the price of the goods, which filled up the boxes, in full, they are entered in the draw twice, as well as in the case of registration or logging in and making 2 contest purchases, each of them separately and at different times, but in the contest period).
The contest Organiser has provided a total of 10 Tree House cans of beer to the contest, according to the Organizer’s random selection; 1 can has a volume of 1 pint.
A total of 10 winners will be selected in the Contest. The Organiser will select 10 winners within 5 business days following the end of the contest by a draw based on the principle of random selection. Each one of them must fulfil all the conditions for participation in the contest. Each winner will receive 1 Tree House can of beer of 1 pint according to the Organiser’s random selection. Any Contestant who does not duly fulfil any of the conditions for participation in the contest in accordance with the relevant provisions of these rules loses the right to win the prize. In the event that the already selected winner loses the right to claim the prize, the Organiser is entitled to select a substitute winner within 7 days of the date of excluding the winner in accordance with the procedure laid down in this article of these rules, and to notify them of this fact within the meaning of these rules. Loss of the right to claim the prize will also be announced to any winner who has lost the right to the prize.
The prize shall be delivered to the winner at the Organiser’s cost to the delivery address stated in the registration, via a transport company within 10 days following drawing of the winners. The winner acknowledges that the Organiser is entitled to provide their personal data to a third party for the purpose of delivering the prize. At the same time, the third party is entitled to use these data only for the purpose of delivering the prize and to process them for 3 months at maximum. The risk of damage to a prize shall pass to the winner upon its handover. The contestant cannot claim a prize other than the one provided to them and is not entitled to reclaim the prize from the Organiser. Neither cash nor any other form of substitute performance may be provided instead of the prize. Prizes in this contest cannot be exchanged for cash, nor is it possible to require a prize other than the prize specified by the Organiser in these rules.
The Organiser shall not be liable for any risks or obligations related to the use of the prize.
Granting of consent to the processing of the Participant’s personal data constitutes a pre-condition for participation in the Contest. The scope and purpose of the processing of personal data are defined within the registration form and these Contest Rules. By withdrawing consent, if it is served before the prize is handed over, the Contestant is excluded from participation in the Contest and loses the right to win the prize in the Contest. The Organizer of the contest points out that the winner’s phone number and the address for the prize delivery will be processed for the purpose of participating in the contest and handing over the prize to the contest winners.
The Contestant explicitly agrees that the Organizer is entitled to use free of charge in accordance with the provision of Section 77 et seq. of Act No. 89/2012 Coll., as amended, their name and surname in the media (including on the Internet), in promotional and advertising materials of the Organiser in relation to this contest and in relation to the promotion of products and services of the Organiser for a period of two years following the end of the contest. The specified recordings may be captured particularly in connection with drawing of the winners and used free of charge in the ways specified in this paragraph.
Personal data shall be processed for 2 years following the end of the contest. The Organiser is entitled to process contestants’ personal data in full and for the purpose stated above even via third parties authorised by the Organiser. The contestants and winners bear in mind that their personal data will be processed for this purpose. Personal data are provided voluntarily by contestants for the given purpose, without the need to give their consent on the basis of the fulfilment of the rights and obligations of this contest.
By participating in the contest, the contestant confirms that they have familiarised themselves with the wording of these Contest Rules. The Organiser reserves the right to amend the contest rules or conditions at any time, including its term, or to cancel the contest in its entirety without giving a reason or providing a substitution. The Organiser is obliged to inform all contestants of any change in the contest conditions without delay. In the event of reasonable suspicion of fraudulent, dishonest or unfair conduct by a contestant or other person who helped or may have helped the contestant to win, or if such conduct occurs, the contestant may be excluded from the contest. The Organiser is not liable for damage in relation to participation in the contest. In the event that the winner cancels the contest order on the basis of which they received the prize, they must also return the prize to the Organiser. By participating in the contest, the contestant is not automatically entitled to the prize and the prize cannot be legally enforced.
These rules, the contest, and relations between the Contestant and Organiser shall be governed by the legal order of the Czech Republic, even in case the Contestant does not reside in the territory of the Czech Republic (the conflict of legal provisions of international private law are excluded). This is without prejudice to the consumer’s rights under generally binding laws and regulations. Possible disputes shall be resolved by competent courts of the Czech Republic in the Czech language. In addition to these terms and conditions, the relationship between the Organiser and the Contestant is subject to certain provisions of the Business Terms and Conditions published in the Internet Store www.pivovarzichovec.cz.
These rules are valid and effective from 4th of May 2021. These rules may be unilaterally modified by the Organiser at any time. The amendment takes effect on the date of publication (similarly as these rules)
